What Is A Wrongful Death Claim?

If your family member died as a result of another party’s negligent actions, you may seek damages for the financial losses and the personal loss of a loved one caused by the accident. Your claim will be filed against the responsible party’s insurance company. For example, if your family member was fatally injured on another party’s property, their homeowner’s or other property insurance would pay out your compensation.

This is in large part why insurance policies exist. There is no shame in seeking damages from the insurance policy of the party that injured your loved one. You likely have significant financial and personal losses, and the insurance payout can help you cover them. We can explain this further if you have questions.

Wrongful Death FAQ

Who can file a wrongful death lawsuit?

In a fatal accident claim in Minnesota, there are many family members who may seek damages. One person, who is often a family member, is appointed the trustee (representative) of the deceased. Working with a lawyer, they file the claim.

There are numerous family members who have the potential to receive compensation in a wrongful death case, including the spouse, children, siblings, parents, grandparents, aunts and uncles, and nieces and nephews. This does not necessarily mean that all parties will get compensation; the court decides the amount of loss that each one suffered. Each case is different, so you need a lawyer to advocate for you in your case.

What compensation is available in wrongful death cases?

Minnesota law allows the following types of damages in wrongful death cases:

  • Medical bills from the accident or injury that caused the death
  • Funeral and burial costs
  • Conscious pain and suffering your family member experienced prior to death
  • Lost wages and benefits that they would have contributed to the household in the future
  • The loss of a loved one/loss of counsel, which includes noneconomic contributions to the household

In some cases, you may also be able to receive punitive damages. This is less common but may apply if the responsible party was egregiously negligent or reckless.
